business conditions

Subject of Contract
These terms are applicable to all contracts of any kind made by the Hotel Eden and its clients and apply to all reservations, bookings and agreements for accommodation, dining, function room hire and use of all facilities at the Hotel Eden.
The contract is considered entered into as soon as the confirmation of the booking is received by mail, fax or email.

If cancellations of the whole reservations are made, the client will be obliged to pay the following cancellations charges:

Options
Options dates are binding for both parties. At the expiry of the options the Hotel Eden can automatically dispose over the reserved rooms, insofar as there will be no written assignment-confirmation issued by the client. The Hotel Eden has to be in possession of the assignment-confirmation on the last day of the period of the option.

Withdrawals of Reservations
If you guaranteed your reservation by credit card, but cannot maintain it, the guest agrees to pay charges to the Hotel Eden in the event of a non-appearance, a belated cancellation or if the client and/or their guests fail to take up the reservation on the arrival day. The charges amount corresponds to our cancellation details.

In the case of a falsely filled in credit card number through an online booking, the reservation will be considered as not guaranteed.

We kindly ask you to inform us in writing at early stage concerning any changes of your booking.

We reserve ourselves to require for the reservation totally or partly pre-payments.

20 to 10 days prior to arrival:  0% of the total amount (high – and low season)
9 to 3 day prior to arrival:     40% of the total amount
The Hotel Eden reserves the right to keep the pre-payment for weekend stays.

Arrival and Departs
The rooms are ready from 2pm. If the guests will arrive later than 6pm, they have to contact the Hotel, otherwise the Hotel Eden has the right to resell the rooms.

At the depart day the check- out is till 12am.

Payments
The Hotel Eden may request advance payment to the half or whole amount of the agreed price. Groups with a foreign address are asked to declare a credit card number including the expiry date as a guarantee.  Please take notice that no invoices are issued into foreign countries.

Tourist Association Taxes
The tourist association taxes are integrated in the price.

Value Added Tax
The value added tax is integrated in the price.

Damages
The contract partner of the Hotel Eden or the guest itself or as a host is fully liable towards the hotel for any damage caused by itself or its guests.

Theft
Any liability of the hotel for thievery and damages and losses on personal items caused by itself or its guests will be excluded.

Lost & Found
Lost property will only be forwarded on special request. The guest bears the costs and risk for the delivery.

Customer request
Especially customer requests are not binding.

Applicable Law, Legal Venue
Swiss law shall apply to the contract between the Hotel Eden and its guests.
The place of performance and jurisdiction is Maloja.
